  The Regulations on the Construction and Management of Talent Apartments in Guangzhou Baiyun District is hereby issued to you for your compliance and implementation. Problems encountered in the implementation shall be directly reported to Baiyun District Housing and Transportation Bureau.

  Regulations on the Construction and Management of Talent Apartments in Guangzhou Baiyun District

  Chapter I General Provisions

  Article 1In order to implement the workforce development strategy, optimize the environment for talent aggregation in Baiyun District, establish a sound mechanism for talent housing solutions and service assurances, and attract outstanding talents to establish their businesses and careers in Baiyun District, these regulations are formulated based on the local conditions in Baiyun District, in line with relevant documents such as the Notice of the Guangzhou Municipal Housing and Urban-Rural Development Bureau on Printing and Distributing the Management Measures for Talent Apartments in Guangzhou(Normative Document No.17 [2019] of Guangzhou Municipal Housing and Urban-rural Development Bureau) .

  Article 2 These regulations shall apply to the construction, fundraising, allocation management, and related activities of talent apartments in Baiyun District. Allocation plans for specific talent apartment projects will be formulated separately.

  Article 3The term “talent apartment” in these regulations refers to housing funded and constructed by the district government, entities entrusted by the district government, or other societal forces. These apartments are provided to qualified talents within Baiyun District.

  Article 4Baiyun District Housing and Transportation Bureau is responsible for formulating policies, providing policy guidance, making plans, and supervising the management of the district-level talent apartments throughout the region.

  The institution designated by Baiyun District People’s Government for talent apartments is responsible for the construction, fundraising, allocation, and management of the district-level talent apartments, including tasks such as daily maintenance, lease contract signing, and rent collection.

  The relevant expenses associated with the construction, fundraising, and management of the district-level talent apartments are incorporated into Baiyun District’s annual financial budget.

  The Organization Department of CPC Baiyun District Committee, the United Front Work Department of Baiyun District, Baiyun District Development and Reform Bureau, Baiyun District Bureau of Science, Industry and Information Technology, Baiyun District Finance Bureau, Baiyun District Human Resources and Social Security Bureau, Baiyun Branch of Guangzhou Planning and Natural Resources Bureau, Baiyun District Investment Promotion Bureau, Baiyun District Land Development Center, and other relevant departments are required to fulfill their responsibilities according to functional divisions such as conducting land surveys, reserves, planning, construction, allocation, management, supervision, and budgetary support for talent apartments, thus comprehensively improving the housing conditions for talents.

  Chapter II Planning and Construction

  Article 5Talent apartments can be built through supporting construction or centralized construction. Other methods such as market property acquisition (purchase or lease), government housing stock takeover and revitalization, and acceptance of donated properties can also be used to offer talent apartments. It is encouraged to adopt collaborative initiatives between the government and social capital to support the construction and fundraising of talent apartments.

  Article 6The District Housing and Transportation Bureau, in coordination with the Organization Department of CPC Baiyun District Committee, Baiyun District Bureau of Science, Industry and Information Technology, Baiyun District Human Resources and Social Security Bureau, Baiyun District Investment Promotion Bureau, and other pertinent departments, shall establish an annual plan for talent apartment demand. Baiyun Branch of Guangzhou Planning and Natural Resources Bureau, guided by the annual talent apartment demand plan, will collaborate with Baiyun District Land Development Center to formulate an implementation scheme for talent apartment supporting construction, subject to approval by Baiyun District Government.

  Article 7Construction Methods

  Talent apartments shall be primarily built through supporting construction, supplemented by centralized construction.

  1. Supporting Construction: This approach requires that talent apartments shall be built by adhering to stipulated agreements for construction and handover. Channels for supporting construction mainly include:

  a. The proportion of public rental housing and talent apartments allocated to annual urban renewal projects and ordinary commercial residential land sold by auction in this region shall be handled in accordance with relevant regulations and shall be determined based on annual demand and the availability of housing resources.

  b. In value innovation parks, significant innovation functional zones, and industrial parks:

  (1) Within the land designated for new industrial projects in areas where industries and talents converge, supporting construction may include production services, administrative offices, and living service facilities, the total built-up area of which shall not exceed 15% of the project’s total building area. The proportion of talent apartments and public rental housing (including staff dormitories) can reach up to 50% (i.e., 7.5% of the project’s total building area).

  (2) In value innovation parks, significant innovation functional zones, national-level, provincial-level parks, and areas with convenient transportation in the vicinity, supporting construction may include production services, administrative offices, and living service facilities, the total built-up area of which shall not exceed 35% of the park’s total building area. The proportion of talent apartments and public rental housing (including staff dormitories) can reach up to 50% (i.e., 17.5% of the park’s total building area).

  The supporting construction requirements for production services, administrative offices, and living service facilities within industrial land in the above-mentioned parks shall be implemented in accordance with the relevant provisions of the Notice of the General Office of Guangzhou Municipal People’s Government on Issuing the Implementation Measures of Guangzhou City for Improving the Efficiency of Industrial Land Use(Normative Document No. 5 [2022] of the General Office of Guangzhou Municipal People’s Government). If policy updates, the latest policy documents shall be followed.

  2. Centralized Construction: The reserved land for affordable housing projects of the district government may be used for the centralized construction of talent apartments upon approval. The specific approval procedures may be implemented with reference to the procedures for public rental housing.

  Article 8Fundraising Methods

  1. Optimal Utilization of Government-owned Housing Resources: By optimizing and utilizing government-owned housing resources, ineligible residents can be relocated, and public housing resources that meet the usage conditions can be repurposed for talent apartments.

  2. Conversion from Demolition and Resettlement Housing: Surplus housing from demolition and resettlement projects, originally attached to ordinary commercial residences, may be converted for use as talent apartments with the approval of the district government after meeting the housing acquisition needs.

  3. Optimal Utilization of Housing Resources in the Market: Market housing resources can be used as talent apartments through acquisition or leasing.

  Article 9Talent apartments are designed to meet the residential needs of individuals at different levels and shall be equipped with necessary living facilities. Newly constructed talent apartments shall offer various unit types based on demand. The floor area of a single unit shall mainly be less than 90 square meters and in principle shall not exceed 120 square meters. For talent apartments targeting individuals with high-level skills, the floor area per unit shall adhere to the relevant regulations for high-level talents, with the maximum area not exceeding 200 square meters.

  Article 10The residential portion of newly constructed talent apartment projects supplied through allocation, agreement transfer of land or public transfer shall be confirmed as a whole in the allocation decision or transfer contract. The real estate registration department shall indicate the usage as “Talent Apartments” on the real estate certificate and registration book, with a note stating “not eligible for separate registration, separate transfer registration, and separate mortgage registration. However, it is permissible to mortgage or transfer as a whole (entire building) in accordance with the law, and the nature of the talent apartment remains unchanged after transfer.”

  Article 11The planning and site selection of talent apartment projects shall consider factors such as integrating industry and city, and balancing work and residence. Priority shall be given to regions with relatively convenient urban rail transportation, relatively concentrated industrial layout, and relatively complete public facilities. Public facilities such as education, healthcare, roads, and public transportation shall be synchronously provided.

  Chapter III: Application, Allocation, and Management

  Article 12 Eligible Recipients for District-Level Talent Apartments

  1. Holders of the Baiyun District Yunju Talent Diamond and Gold Card, or other district-level high-level talents recognized by the Leadership Group Office for Talent Works of CPC Baiyun District Committee.

  2. Middle- and high-level talents in district-level party and government organs and institutions. Specific criteria shall be formulated by the Organization Department of CPC Baiyun District Committee and Baiyun District Human Resources and Social Security Bureau.

  3. Middle- and high-level talents approved by CPC Baiyun District Committee or District Government, whose approved documents are the guidance of the identification criteria.

  4. Young talents from Hong Kong, Macao, and Taiwan working or starting businesses in Baiyun District. Specific criteria shall be formulated by Baiyun District United Front Work Department and Baiyun District Human Resources and Social Security Bureau.

  5. Talents from key enterprises, including individuals from enterprises that have signed investment or cooperation agreements with Baiyun District Government or various investment promotion departments. The list of key enterprises shall be determined and formulated by the Baiyun District Bureau of Science, Industry and Information Technology, Baiyun District Investment Promotion Bureau, and other relevant departments. Individuals from enterprises that have signed investment or cooperation agreements with the District Government or various investment promotion departments shall be allocated talent apartment quotas based on the agreements. The enterprises themselves shall determine the talents who can get talents apartment quotas and the allocation results shall be submitted to Baiyun District Housing and Transportation Bureau and the talent apartment agency designated by the District Government. Regarding the allocation quotas for enterprise talents, the Baiyun District Bureau of Science, Industry and Information Technology is responsible for the existing enterprises within the district and the various investment promotion departments are responsible for investment-attracting enterprises within the district, in accordance with the principle of “who manages or attracts the talents, who formulates allocation plan”, After approved by the working meeting chaired by the Deputy Head of Baiyun District, the quota allocation plan shall be reported to the District Housing and Transportation Bureau and the District Human Resources and Social Security Bureau. The formulation of quotas shall fully consider the reserve of talent apartment housing resources in Baiyun District.

  6. Other young talents employed by enterprises in Baiyun District who are aged 35 or below and meet any of the following conditions:

  a. Holding a master’s graduation certificate or above and a master’s degree or above from a top domestic university (or top-tier discipline).

  b. Holding a master’s graduation certificate or above and a master’s degree or above from a top 500 global university.

  When there is an oversupply of district-level talent apartments, the eligibility criteria for such talents may be adjusted based on the actual situation to: individuals employed in enterprises in Baiyun District who are aged 35 or below, holding a full-time undergraduate graduation certification and a bachelor’s degree (or intermediate professional technical title, or national vocational qualification second-level skill grade).

  Article 13Individuals applying to lease district-level talent apartments shall meet the provisions of Article 12 and the following conditions:

  1. Employed within the administrative region.

  2. The applicant, his or her spouse, and underage children do not own residential properties with property rights in Guangzhou (excluding high-level talents at the municipal level) and are not entitled to talent apartments.

  Article 14Qualified talents meeting the criteria may apply to lease only one talent apartment within the entire city. Two or more qualified talents from the same entity may apply to share one talent apartment, with a maximum floor area not exceeding 120 square meters. If both spouses meet the application criteria, they shall apply to lease one talent apartment as one household, with a maximum floor area not exceeding 120 square meters. For high-level talents, the floor area shall follow the provisions of Article 9.

  Article 15Qualified talents as per item 1, 3, and 4 of Article 12, are generally required to apply for leasing in their personal or family name. For other types of talents, the principle is to adopt the method of overall leasing by the institution. Talents meeting the criteria of item 3 and 4 of Article 12, may also adopt the method of overall leasing by the institution.

  Article 16Allocation Procedure for District-Level Talent Apartments

  1. Application in Personal or Family Name

  a. Announcement of Housing Information: The owner of the talent apartments (individuals or institutions) or the designated talent apartment agency shall, based on the progress of construction and fundraising, disclose information about talent apartment housing on the official website of the Baiyun District Government.

  b. Application Reception. Applicants shall download the Application Form for District-Level Talent Apartments in Baiyun Districtfrom the official website of the Baiyun District Government, complete it truthfully in accordance with the requirements, and submit the application to their respective workplaces. The applicants shall provide a written notification informing what types of talents they are, and the identities of and the relationship between the applicants and their family members (limited to spouse and underage children, hereinafter the same) .

  c. Initial Review. The applicant’s respective workplace shall, within 10 working days from the date of application acceptance, conduct an initial review of the applicant’s family, talent qualifications, and other declared information. The workplace shall submit the application materials and review opinions to Baiyun District Housing and Transportation Bureau, who will synchronously forward the relevant documents to the corresponding review institution.

  d. Review and Public Announcement: Baiyun District Housing and Transportation Bureau shall, within 20 working days from the receipt of the submitted materials, review the applicant and their family members’ ownership of residential properties in this city, subsidies for housing for high-level talents, residency in talent apartments or other government-subsidized housing. The review institution shall, within 15 working days from the receipt of the submitted materials, complete the talent qualification review and submit the review results to Baiyun District Housing and Transportation Bureau.

  (1) For talents meeting the criteria of item 1 and 3 of Article 12, the review institution shall be the Organization Department of CPC Baiyun District Committee and Baiyun District Human Resources and Social Security Bureau.

  (2) For talents meeting the criteria of item 4 of Article 12, the review institution shall be Baiyun District Human Resources and Social Security Bureau.

  Baiyun District Housing and Transportation Bureau will consolidate the review results and publish them on the official website of the Baiyun District Government, with a public announcement period of 15 days. For high-level talents in the district that require case-by-case negotiation, the Housing and Transportation Bureau shall submit the matter to Baiyun Leadership Group Office for Talent Works for negotiation. The negotiated results will be published on the official website of the Baiyun District Government, with a public announcement period of 15 days.

  e. Publication: In case there are no objections during the public announcement period or if objections are verified as invalid, the Housing and Transportation Bureau, together with the District Human Resources and Social Security Bureau, shall approve the qualified applicants within 3 working days and publish the list of eligible applicants on the official website of the Baiyun District Government.

  f. Allocation. The owner of the talent apartments (individuals or institutions) or the designated talent apartment agency shall, based on the applicant’s application time, talent level, and the availability of housing resources, timely formulate an allocation plan. The plan shall be submitted for deliberation to Baiyun Leadership Group Office for Talent Works and subsequently published upon approval.

  g. Arrangement for Talent Apartment Occupancy: The owner of the talent apartments (individuals or institutions) or the designated talent apartment agency shall arrange for the applicants to move into the talent apartments according to the allocation results. The allocation results shall be publicly disclosed through the official website of the Baiyun District Government.

  2. Institutional Overall Leasing:

  a. Announcement of Housing Information: The owner of the talent apartments (individuals or institutions) or the designated talent apartment agency shall, based on the progress of talent apartment construction and fundraising, publish information about talent apartment housing on the official website of the Baiyun District Government.

  b. Application Reception and Review: Eligible entities shall submit application materials and review opinions to Baiyun District Housing and Transportation Bureau, who will synchronously forward the relevant documents to the corresponding review institution. Within 20 working days from the receipt of the institution’s submitted materials, the Housing and Transportation Bureau shall review the residency situation of the applicants and their family members in talent apartments and other government-subsidized housing. The review institution shall, within 15 working days from the receipt of the submitted materials, complete the review of the application of institution and individual, and submit the review results to the Housing and Transportation Bureau.

  (1) For talents meeting the criteria of item 2 and 3 of Article 12, the review institution shall be the Organization Department of CPC Baiyun District Committee and the District Human Resources and Social Security Bureau.

  (2) For talents meeting the criteria of item 4 of Article 12 , the review institution shall be the District Human Resources and Social Security Bureau.

  (3) For talents meeting the criteria of item 5 of Article 12, the review institution shall be the department responsible for setting the talent apartment quotas.

  (4) For talents meeting the criteria of item 6 of Article 12, the review institution shall be the District Human Resources and Social Security Bureau.

  c. Formulation of Allocation Plan: The owner of the talent apartments (individuals or institutions) or the designated talent apartment agency shall formulate an allocation plan, taking into consideration urban development, industrial needs, the location and quantity of available housing, and application status. The allocation plan shall be submitted for deliberation to Baiyun Leadership Group Office for Talent Works.

  d. Overall Allocation: The owner of the talent apartments (individuals or institutions) or the designated talent apartment agency allocates housing to various institutions according to the housing allocation plan. The allocation results shall be announced to the public through the official website of the Baiyun District Government. Institutions shall sign comprehensive leasing contracts with the owner of the talent apartments (individuals or institutions) or the designated talent apartment agency within the specified time.

  e. Subleasing by Institutions: Employers, based on housing availability and demand, formulate specific allocation and management plans through a democratic decision-making process. Employers sign housing lease contracts with eligible employees from their organization, and submit the allocation results to the owner of the talent apartments (individuals or institutions) or the designated talent apartment agency.

  Article 17If enterprises or institutions construct and fund talent apartments independently, they shall primarily provide housing to the talents within their organization. If there are surplus housing units, they may supply them to talents designated by the district. The specific allocation plan shall be formulated and implemented by the employer based on relevant policies, and the allocation results shall be reported to Baiyun District Housing and Transportation Bureau.

  Article 18Talent apartments at the district level for overall leasing by institutions shall follow the principle of supply and demand matching and dynamic adjustment. The owner of the talent apartments (individuals or institutions) and the designated talent apartment agency may dynamically adjust the talent apartment allocation plan to improve the efficiency of talent apartment utilization based on the implementation situation and the subleasing and rent payment situation by the lessee organizations.

  Article 19Rent Payment Method. For those who apply for leasing in their personal or family name, the rent is paid individually. For those who apply for leasing through institutional overall leasing, the rent is paid by the employer.

  Article 20The rent for talent apartments is calculated based on the area of a single unit. The rent standard refers to the market rent standard for similar types of housing in the same location. It is determined by the owner of the talent apartments (individuals or institutions) or the designated talent apartment agency and submitted to the District Development and Reform Bureau and the Housing and Transportation Bureau. The rent standard shall be adjusted timely based on the socio-economic development and price fluctuations. District-level talent apartments implement differentiated rent based on the type of talents, as detailed below:

  1. Holders of Baiyun District Yunju Talent Diamond Card or other district-level high-level talents recognized by the Leadership Group Office for Talent Works of Baiyun Committee, the rent is charged at 70% of the rental standard of the leased talent apartment project.

  2. Holders of Baiyun District Yunju Talent Gold Card, and talents meeting the conditions of Item 3 and 4 of Article 12, the rent is charged at 80% of the rental standard of the leased talent apartment project.

  3. Talents meeting the conditions of Item 5 of Article 12, if there are clear agreements on rent reduction or exemption in investment agreements, cooperation agreements, etc., those agreements will be implemented. If there are no explicit provisions regarding this, the rent is charged according to the rental standard of the leased talent apartment project.

  4. Talents meeting the conditions of Item 2 and 6 of Article 12, the rent is charged according to the rental standard of the leased talent apartment project.

  High-level talents, in addition to enjoying differential rents as specified above, can also choose to follow the relevant regulations for high-level talents.

  If there are explicit provisions regarding rent reduction or exemption for talent apartment occupancy in the talent introduction methods issued and implemented in various industries in Baiyun District, they can continue to be executed in accordance with the relevant regulations of the corresponding talent introduction methods.

  Article 21The rental income of the district-level talent apartments constructed by government shall be paid to finance at the same level in accordance with the regulations on the management of non-tax revenue by the government. This follows a dual-line management of revenue and expenditure. The annual maintenance and repair expenses for district-level talent apartments will be centrally arranged and solved through financial budgeting. The designated institutions by the district government for talent apartments are responsible for the maintenance and repair of district-level talent apartments and their supporting facilities. They shall ensure the normal use of talent apartments, conduct regular or irregular inspections, and promptly address any violations.

  Article 22The contract lease term for district-level talent apartments is 5 years, and the tenants occupying talent apartments shall comply with the housing management regulations. Upon expiration, if the applicant still meets the supply conditions for district-level talent apartments and needs to renew the lease, they may apply for renewal after approval. The applicant shall submit a renewal application to the implementing institution three months before the contract expires.

  Upon expiration, if the applicant still meets the supply conditions for district-level talent apartments but fails to submit a renewal application within the specified period, the applicant must settle all fees and vacate the talent apartment within 60 days from the contract expiration date. In cases of contract termination or if the applicant no longer meets the supply conditions for district-level talent apartments after the expiration, the applicant must voluntarily vacate the talent apartment, settle all fees, and complete the vacating process within 60 days from the contract termination date.

  During the vacating period, the tenant will no longer enjoy rental discounts and must pay rent according to the rental standards of the leased talent apartment project.

  Article 23 The lease agreement shall specify the basic information of the property, rental standards, rent payment methods, lease term, usage management, contract termination, responsibilities for breach of contract, and the rights and obligations of both parties.

  Article 24Talents who have leased public housing under direct management, institution-managed housing, or public rental housing shall move out within one month from the check-in date of the district-level talent apartment. Those fail to move out within the specified period will be deprived of the right to resident in the district-level talent apartment.

  Article 25Talent apartment tenants shall timely pay rent and the utility charges, including water, electricity, gas, network, cable TV, property services, and other shared expenses incurred during the use of the property.

  Article 26During the lease period of the district-level talent apartment, if the tenant meets any of the following conditions, the qualification for leasing the talent apartment shall be revoked, and the housing shall be reclaimed by the talent apartment agency designated by the district government or the institution leasing it as a whole. If the actions constitute a crime, the individual shall be held criminally responsible in accordance with the law.

  1. In arrears of pay rent for two consecutive months or six accumulated months, or leaving the talent apartment vacant for more than six consecutive months without justified reasons.

  2. Illegally lending, subleasing, subletting part of the leased talent apartment, or making unauthorized expansions, additions, alterations, or changes to the structure or purpose of the housing.

  3. Intentionally damaging or destroying the leased talent apartment or its ancillary facilities and equipment.

  4. Repeatedly engaging in activities such as disorderly stacking of items, improper disposal of garbage, occupying green spaces, or violating public order, causing a severe impact on environment or the normal lives of others, with repeated warnings proving ineffective.

  5. Other cases of violating laws, regulations, rules, and normative administrative documents.

  Article 27The talent apartment lease contract at the district level may be terminated if the tenant meets any of the following conditions:

  1. The tenant no longer works within Baiyun District or is not employed by the tenant institution.

  2. The tenant, their spouse, or minor children own residential properties in Guangzhou (excluding high-level talent at the municipal level).

  3. The tenant fails to vacate the public housing under direct management, institution-managed housing, or public rental housing within the specified period according to Article 24.

  4. The talent qualification certification is revoked.

  Article 28Baiyun District Housing and Transportation Bureau, in collaboration with relevant departments, shall establish an information system for talent apartment management to enhance housing and resident file management.

  In cases where talent apartments are constructed and funded by private entities, they shall ensure proper management of statistics and files for housing and residents.

  Article 29Employers leasing district-level talent apartments as a whole shall implement dynamic management of the talents who rent the apartment. They shall promptly report to the designated talent apartment agency appointed by the district government and apply for necessary changes related to the tenancy.in cases where tenants leave their jobs, undergo transfers, purchase houses, or are involved in legal violations. If failure to report changes in a timely manner leads to adverse consequences, both the tenant and the employer shall bear corresponding responsibilities.

  Article 30For individuals and entities who break their promises, or take fraudulent or other improper means to obtain talent apartments at the district level, the talent apartment agency designated by the district government shall recover the improper gains and take back the housing, and the rent difference shall be recovered based on the talent apartment project’s rental standards. Their application shall not be accepted within a period of 5 years.

  Chapter IV Supplementary Provisions

  Article 31Any matters not expressly addressed in these regulations shall be governed by applicable national, provincial, and municipal laws and regulations. Additionally, in cases where conformity with both municipal and district talent apartment preferential policies is met, support shall be provided in adherence to the non-repetition principle, unless otherwise specified.

  Article 32 These regulations shall enter into force on January 1, 2024, for a period of three years.
